Privacy Policy

This Privacy Policy discloses the privacy practices for www.guildquality.com (including all sub-domains, the "Sites"), which are owned and operated by GuildQuality, Inc. ("GuildQuality," "our," "we" or "us") as well as the use of any mobile device application created by GuildQuality (each, the "Mobile App") and our web-based GuildQuality applications (collectively, the “Management Apps”). GuildQuality provides a public service to individual consumers (“Homeowners”) who may access the Sites for information about home improvement and home contractors, to find a builder or home improvement contractor, to recommend a contractor, to provide feedback regarding an experience with a contractor, or to ask, answer, or review questions about home improvement. Home improvement contractors and service providers (“Guildmembers”) access the Sites to list and promote their services, create and disseminate satisfaction surveys to their customers, review customer survey results, and publish and promote customer feedback. Construction and other home improvement service workers (“Crew” or “Crewmembers”) use the Crew web-based and Mobile App to share information about jobsites, endorse and review colleagues, and otherwise participate in industry networking activities. Services provided via the Sites, Mobile App, and Management Apps to Homeowners, Guildmembers, and Crewmembers may be collectively referred to as our “Services.”

This Privacy Policy applies to our collection and use of information from all users of GuildQuality Services, including without limitation visitors using only free services offered on the Sites, and is incorporated into our Terms of Use. Please note that this Privacy Policy does not address the privacy practices of third parties, including those with whom we may share information as set forth below. Please review the privacy policies of any third parties before you disclose information to them. Through your use of any GuildQuality Services, you consent to the practices described in this Privacy Policy.

Collection and Use of Personal Information

We collect information, including personal information from you when you register for a Homeowner, Guildmember, or Crewmember account, when you provide feedback on a Guildmember listed on the Sites, when you subscribe to a newsletter or blog, when you submit or answer a question, or when you provide your information to us directly through any GuildQuality Service. For purposes of this policy, “personal information” refers to any information about an identified or identifiable individual, including financial account information.

We collect personal information from and about Guildmembers through paid GuildQuality Services, and publish that information in public directories. We collect personal information from and about consumers and other individuals who as free Homeowner or Crewmember users of the Sites submit their information for a specific purpose; and we utilize that information to fulfill that purpose.

We collect personal information from consumers, who may be Homeowners, as part of conducting customer satisfaction surveys on behalf of Guildmembers or as part of research on homecare industry trends. Personal information collected as part of a survey conducted for a specific Guildmember is shared with that company to help it understand and manage customer satisfaction and relationships.

When you download and use our Mobile App we may also collect certain information automatically, such as the type of mobile device you use, your unique device ID, the IP address of your mobile device, your mobile phone number, your mobile operating system, the type of mobile internet browsers you use, and information about the way you use the Mobile App. If you provide permission while installing the Mobile App we also collect precise information about the location of your device.

By providing information to us through any GuildQuality Services, consumers consent to our collection of such information and our sharing of that information as set forth in this policy. In cases where Guildmembers enter a consumer’s personal information into our systems, including in cases where customer lists are imported into our systems, Guildmembers certify that they have received any required authorization to do so from the consumer. Additionally, Homeowners, Guildmembers, and Crewmembers certify that in all cases where personal information is submitted via GuildQuality Services that the disclosure does not violate any law or regulation.

We generally collect and use information as follows:


From Guildmembers with a Free Account or Demo Account
To obtain a GuildQuality free trial or demo Guildmember account you are required to give us contact information (name, business name, phone number, e-mail address, website, and basic information about your business and industry). We use this information to configure your account for utilizing online feedback tracking, reporting, and marketing components of the Service. We may also use this information to communicate with you about your free account usage, to provide account-specific technical support, and to provide information to you about additional GuildQuality products and services that we believe may be of interest to you.

In order to utilize the free trial survey portion of the Services Guildmembers are required to provide customer lists containing personal information. This information is utilized by GuildQuality solely for the purpose of providing the Services, and is not disclosed to third parties except as disclosed in this Privacy Policy. You represent and warrant that you have the right and authorization to provide GuildQuality with any information, content, data, or materials provided by you, and that the disclosure does not violate the any law or regulation.

When a Guildmember posts an answer or comment to the GuildQuality Answers board, we store the Guildmember’s profile information along with the entered text/comments and images included in the answer or comment. Guildmembers understand that any information or images submitted via an Answers board form may be made public in any form (including but not limited to any edits deemed appropriate by GuildQuality) at the sole discretion of GuildQuality. Guildmembers submitting content to the Answers board represent and warrant that the disclosure of any information, content, images, data, or materials provided is properly authorized, anonymized where necessary, and does not violate any copyright, law, or regulation.

We may use your personal information to send you promotional products and information about GuildQuality, the Sites, and/or on behalf of our parent company, partner companies, subsidiaries and affiliates. We may also create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you. We may use this anonymous information to direct future development, including but not limited to analyzing usage patterns so that we may enhance our services, and to provide reporting based on anonymous non-personal information.


From Guildmembers with a Paid GuildQuality Account
To obtain a GuildQuality Guildmember account, you must provide contact information (name, address, phone number, and e-mail address) in addition to other personal information and information about your company, and payment information to authorize automatic recurring billing for your membership and other associated usage fees. In order to utilize the survey portion of the Services, Guildmembers are required to provide customer lists containing personal information. This information is utilized by GuildQuality solely for the purpose of providing the Services, and is not disclosed to third parties except as disclosed in this Privacy Policy. You represent and warrant that you have the right and authorization to provide GuildQuality with any information, content, data, or materials provided by you, and that the disclosure does not violate the PCI DSS or any other law or regulation.

We use your personal information to check your company qualifications, to administer your account, to send you information about the surveys conducted on your behalf, to send you account alerts, to send you information related to subscriptions you have signed-up for via the Sites, and to send you information about our company and your account. We use the information you provide about your business as part of the public GuildQuality Contractor Directory. Note that as this is public information, GuildQuality has no control over how third parties may utilize this information.

We use billing and financial information (bank account numbers/credit card numbers) to process recurring membership fees and other fees as applicable, via third-party payment processors. GuildQuality does not store any bank account or credit card information in its own systems. All payment card data and bank account data is stored by our third party vendors who are contractually required to be PCI Compliant and to adhere to all NACHA rules for ACH payment processing.

When a Guildmember posts an answer or comment to the GuildQuality Answers board, we store the Guildmember’s profile information along with the entered text/comments and images included in the answer or comment. Guildmembers understand that any information or images submitted via an Answers board form may be made public in any form (including but not limited to any edits deemed appropriate by GuildQuality) at the sole discretion of GuildQuality. Guildmembers submitting content to the Answers board represent and warrant that the disclosure of any information, content, images, data, or materials provided is properly authorized, anonymized where necessary, and does not violate any copyright, law, or regulation.

We may use your personal information to send you promotional products and information about GuildQuality, the Sites, and/or on behalf of our parent company, partner companies, subsidiaries and affiliates. We may also create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you. We may use this anonymous information to direct future development, including but not limited to analyzing usage patterns so that we may enhance our services, and to provide reporting based on anonymous non-personal information.


From Crewmembers with a Free Crew Account
To obtain a GuildQuality Crew account, you must provide contact information (name, phone number, e-mail address, and you may add additional personal information about yourself, your employer, your colleagues, your projects and your customers. You represent and warrant that you have the right to provide GuildQuality with any information, content, data, or materials provided by you, and that the disclosure does not violate any law or regulation.

We use your personal information to administer your account, to publish the information you designate as public related to your profile, projects, reviews, and check-ins, to send you information related to subscriptions you have signed-up for via the Sites, and to send you information about our company and your account.

When a Crewmember posts a Question or Comment to the GuildQuality Answers board, we store the Crewmember’s profile information (if the Crewmember is logged in while posting), along with the entered text/comments and images included in the Question or Comment. Crewmembers understand that any information or images submitted via an Answers board comment form may be made public in any form (including but not limited to any edits deemed appropriate by GuildQuality) at the sole discretion of GuildQuality. The email address provided may be used to acknowledge the submission and to communicate with the Crewmember regarding the submission. Crewmembers submitting Questions or Comments to the Answers board represent and warrant that the disclosure of any information, content, images, data, or materials provided is properly authorized, anonymized where necessary, and does not violate any copyright, law, or regulation.

We may use your personal information to send you promotional products and information about GuildQuality, our Services, the Sites, and/or on behalf of our parent company, partner companies, subsidiaries and affiliates. We may also create anonymous records from personal information by excluding information (such as your name) that makes the information personally identifiable to you. We may use this anonymous information to direct future development, including but not limited to analyzing usage patterns so that we may enhance our services, and providing reports based on anonymous non-personal information.


From Consumers (Homeowners) accessing and utilizing GuildQuality Sites and Services, with or without a Homeowner Account
Any personal information we collect about a consumer or other individual, is used solely for the purpose of providing GuildQuality Services or as otherwise set forth herein.

To obtain a free Homeowner account you must provide contact information (name, email address, zip code) and set a password. The zip code provided is utilized to tailor the Guildmembers displayed in response to your searching and browsing the Sites. This information may be used by GuildQuality for communicating with you about the registration, for administering our Services, and for internal analysis of site usage, and sales and marketing campaigns.

When a Homeowner or other consumer subscribes to a GuildQuality newsletter or blog, we collect and store’s the Homeowner’s email address. The email address is used to send newsletters, blog posts, blog comment summaries, and other information based on the selections made by the Homeowner. Additionally, GuildQuality may use the email address of any subscriber to send occasional email updates on helpful resources related to home care, home improvement, or other home service related topics.

When a Homeowner or other consumer posts a Question or Comment to the GuildQuality Answers board, we store the Homeowner’s profile information (if the Homeowner is logged in while posting), along with the entered text/comments and images included in the Question or Comment. Homeowners understand that any information or images submitted via an Answers board comment form may be made public in any form (including but not limited to any edits deemed appropriate by GuildQuality) at the sole discretion of GuildQuality. The email address provided may be used to acknowledge the submission and to communicate with the Homeowner regarding the submission. Homeowners submitting Questions or Comments to the Answers board represent and warrant that the disclosure of any information, content, images, data, or materials provided is properly authorized, anonymized where necessary, and does not violate any copyright, law, or regulation.

When a Homeowner provides a review or other feedback as part of being contacted by a GuildQuality researcher or after receiving a mailed or emailed invitation from GuildQuality, we store the Homeowner’s name, email address, phone number, and the full content of the interview or feedback survey. Feedback provided about a Guildmember as part of an interview or online survey is shared with that Guildmember, and may be made public in any form at the sole discretion of GuildQuality, however all feedback and survey responses will be published anonymously unless specific permission for public attribution is provided by the Homeowner. Additionally, aggregated feedback ratings (anonymized such that neither the Homeowner nor the Guildmember may be identified, and including feedback obtained about companies that are not Guildmembers) may be utilized to provide Guildmembers with benchmarks against industry and regional averages related to customer satisfaction.

When a Homeowner provides an unsolicited review or other feedback about a Guildmember via the Sites, the Homeowner’s mailing address is collected along with a star rating for the Guildmember, a written text review, and the date the Guildmember completed the service. The mailing address is used to mail a postcard for use in confirming the Homeowner’s address and the validity of the review. We store all information entered on an unsolicited review form, and it may be made public and/or shared with the reviewed Guildmember at GuildQuality’s sole discretion, however unsolicited feedback will be published anonymously unless specific permission for public attribution is provided by the Homeowner. Additionally, unsolicited feedback may be included in aggregated feedback ratings (anonymized such that neither the Homeowner nor the Guildmember may be identified) utilized to provide Guildmembers with benchmarks against industry and regional averages related to customer satisfaction.

Further, to make our Sites more useful to you, and to adhere to the PCI DSS and other applicable laws and regulations, our servers (which may be hosted by a third party service provider) collect personal information and other data from you, including (without limitation) browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit. Like most internet services, we automatically gather this information and store it in log files each time you visit our website or access your account on our network.

We may also create anonymous records from Personal Information by excluding information (such as name) that makes the information personally identifiable to a specific consumer or other individual. We may use this anonymous information for certain business purposes of GuildQuality or its parent company, subsidiaries or affiliates, including but not limited to, directing future development efforts, analyzing usage patterns so that we may enhance our services, and providing reports based on anonymous non-personal information.


Cookies and Similar Technologies
Certain portions of our Services may collect information via cookies, web beacons, pixel tags, and similar digital tracking technologies. These technologies can be used to collect and analyze other information related to the devices you use to access the Services, such as IP addresses, browser types, browser language, unique device identifiers and other information about your computer(s) and/or mobile device(s).

We may also use these technologies to log click-stream or similar data collected from certain portions of our Sites. Generally, this information is collected when you request pages from our Sites, and typically includes information such as the page served, the time, the source and type of browser making the request, the most recent page view, what you clicked on in order to arrive at our Sites, the content you viewed on our Sites, and other similar information relating to your use of our Sites.

We typically use these cookies and similar technologies for essential and functional purposes (e.g. to maintain an active session), to improve the performance and usability of our Sites, and to analyze how users interact with the Services (e.g. to understand how long users stay on a page, how often they return, and how they arrived at our Site). On certain portions of our Sites and Mobile APP we may collect data through these technologies for advertising, remarketing, or other similar purposes. Click-stream and related data is typically used for purposes of system administration, to improve our Services, for marketing and advertising-related purposes, and other similar uses.

Some tracking technologies on our Services may be provided by a third party (which may collect information on its own behalf, or may provide such information to us). For example, we use Google Analytics on our Sites. Google Analytics is a web analytics service provided by Google. Google Analytics uses cookies to collect anonymous traffic data to help use analyze how users use the website. The information generated by a cookie about your use of the website (including your IP address) will be transmitted to and stored by Google on servers in the United States. Google will use this information for the purpose of evaluating your use of the Sites, compiling reports on Site activity for us and providing other services relating to Site activity and internet usage. Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google’s behalf. By using the Sites, you consent to the processing of data about you by Google in the manner and for the purposes described in this Privacy Policy.

You may control Facebook’s use of interest-based ads through your Facebook account settings, or may visit the customer support page here. Please note, at this time we do not respond to browser-based "do not track" signals.


When you contact us through the Services
When you submit an online "contact us" or other online inquiry form, create a registered free or demo account, create a free demo account, download a Mobile App, or when you call, write, fax or otherwise initiate contact with GuildQuality, we record your contact information (name, address, phone number, and email address) in our CRM (Customer Relationship Management) system. This information is used for answering your questions as well as ongoing marketing communication programs. In some cases, you may be referred to a GuildQuality online inquiry form via a link on a third party referral website. In that case, any information collected on the GuildQuality hosted online inquiry form may be shared with the referring party, and that referring party may use it for their own, non-GuildQuality related, marketing communication programs. If you exchange any messages through our Sites or through our Services, we may store those as well.


From Online Surveys
We may occasionally ask Homeowners, Crewmembers, and Guildmembers to complete optional online surveys. These surveys may ask for contact information, industry information, opinions, and demographic information (like zip code, age or income level). We may use this data to tailor the experience on the Sites, provide content that we think might be of interest, and to display content according to a Homeowner’s, Crewmembers’ or Guildmembers’ stated preferences. We sometimes use contact data from our surveys to send information about our company and/or promotional material on behalf of our parent company, partners, subsidiaries or affiliates.

Third-Party Advertisers, Services, and Websites

The GuildQuality Sites contain links to third-party websites. These links are provided for your convenience and to connect you with resources you may find useful. GuildQuality has no control of such websites and you understand that these websites are not under our control and are not subject to this Privacy Policy. Your use and access to these websites is solely at your own risk; and you should consult the Terms and Privacy Policy for any third-party website you access via a GuildQuality link to determine how they store, process, transmit, and otherwise utilize and protect your personally identifiable information.

GuildQuality may provide the personal information we have collected from and/or about you to third parties for the purpose of enabling them to market their products or services to you if you have not opted out of these disclosures.

You may choose to make use of third party services in conjunction with our Services. Selected third party services, (that are not in any way affiliated with GuildQuality), may be linked with our Services, or our Services may enable you to connect or integrate these third party services with your GuildQuality account. When a connection is established, data associated with your account may be shared with the third party, including personally identifiable information. GuildQuality does not control the policies or procedures of these third parties, even though such third party services are available through our Service. This Policy does not cover the collection or use of information, including your personal information and reviews provided by a Guildmember’s customers, by third parties, and you acknowledge that your use and access to these third party services is solely at your own risk; and you should consult the Terms and Privacy Policy for any third party services you access or integrate with via a GuildQuality account to determine how they store, process, transmit, and otherwise utilize and protect your personally identifiable information and the personally identifiable information you provide about your customers.

How we Share Information with Third Parties

Except as otherwise set forth in this Privacy Policy or in accordance with any request or consent you provide, GuildQuality does not sell, share, or in any other way transmit personal information (names, address, phone numbers, financial account information, etc.), submitted by Homeowners, Crewmembers, or Guildmembers to any other persons or companies. We reserve the right, however, to use and disclose anonymous information to third parties, at our discretion. Except as limited below, third parties may use information we share with them for any purpose for which we may use such information.

Personal information we collect may be shared with service providers who provide certain services on our behalf, including but not limited to, payment processing, business intelligence, customer relationship management, bill collection, marketing, hosting, and other common technology services. We may also receive information about you, including personal information, from our third party service providers. Our contracts dictate that these service providers only use your information in connection with the services they perform for us and in accordance with this Privacy Policy, and you consent to our sharing with these parties by using our Service and accepting the terms of this Privacy Policy.

We may provide information, including personal information of registered Guildmembers to third party referral partners offering ancillary services to those Guildmebers. However, these referral partners do not have any independent right to disclose this information (except to the same extent we would have a right to disclose the information under this Privacy Policy).

If you use the Services to provide feedback, ratings, or other information about a Guildmember or your experiences with a Guildmember, we may grant access to or share with the Guildmember any and all information we collect as part of that communication, and we may provide the Guildmember with the ability to publish (or decline to publish) your feedback with your permission or anonymously without your permission, except where that disclosure is prohibited by law, regulation or other obligations (e.g. for data security).

You hereby agree that we may share some or all of your personal information with a parent company, subsidiaries, joint ventures, or other companies under common control with us (collectively, "Affiliates"). We will require our Affiliates to comply with this Privacy Policy. If our company or some or all of our assets are acquired by another company, any personal or other information we possess may be a part of the assets transferred, and that company will possess any rights granted to us under this Privacy Policy.

Finally, in extraordinary circumstances, we may share any personal or other information we possess, including but not limited to credit card and other financial account information, and content submitted via any form on the Sites, when necessary or appropriate to: comply with the law; cooperate with law enforcement or national security requirements; prevent physical harm to one or more individuals or serve the interest of public safety; respond to lawful requests; comply with law or credit card rules; participate in a lawful federal, state or local government investigation; protect the rights of GuildQuality, GuildQuality Homeowner, Crewmembers, and/or Guildmembers; or to investigate violations of or to enforce our Terms of Service, However, in doing so, we may: (i) dispute demands for release to the extent we believe, in our sole discretion, are unwarranted, illegitimate or overbroad; and (ii) when we determine that it is necessary or appropriate, we will notify you of any requests for release.

Data Retention Policy, Managing Your Information

We will retain personal information for as long as you maintain an active GuildQuality Homeowner, Crewmember, and/or Guildmember Account, and for a reasonable time thereafter.

We may store for as long as a valid business reason exists, which may be indefinitely, any personal information, collected about a consumer or other individual, whether entered directly into our systems via the Sties by the consumer, or entered by an authorized Guildmember user. This includes any information provided as part of solicited or unsolicited feedback and reviews of Guildmembers or other service providers.

We may retain anonymized and aggregate data indefinitely.

Security

GuildQuality takes security very seriously and has security measures in place designed to protect against the loss, misuse and alteration of the information under our control. Our platform uses the most powerful security tools that exist in the marketplace.

The GuildQuality Sites, including hosted web forms, utilize secure SSL for all form data submissions in conjunction with a 256-bit Thawte certificate, but accommodate the majority of browsers at 128-bit encryption.

GuildQuality does not directly store, process, or transmit bank account and credit card information. All payment processing, and collection of payment account data, is accomplished via integration with third-party service providers. These providers are contractually required to maintain compliance with the PCI DSS - Payment Card Industry Data Security Standards, and with all NACHA rules for ACH transaction processing. This includes secure transmission of credit card/bank account information, and encrypted storage of all payment account information.

Choice/Opt-Out

You may opt-out of receiving marketing communications from us by following the opt-out instructions we include in such communications.

You may unsubscribe from any GuildQuality newsletter or blog by following opt-out instructions we include in such communications.

You may opt-out of all of our information collection from your mobile device by uninstalling the Mobile App. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Guildmembers can adjust account preferences in the Management Apps to opt-out of sharing personal information related to certain third party advertising, promotional offers from us or from third parties, and/or targeted online advertising.

To the extent required by law, you may choose to opt out of sharing with any other parties with whom we may share your personal information; however, you may be unable to use the Services or certain features if you wish to limit such sharing.

Accessing, Correcting and Deleting your Information

GuildQuality acknowledges the right of individuals to access their personal data. Homeowners, Crewmembers, and Guildmembers may access and modify personal and other account information using the account settings page. You may also access, change and modify information previously provided or collected by sending an email to GuildQuality at support@guildquality.com to initiate changes or modifications or to obtain a file for review. Note that GuildQuality will require you to verify your identity prior to releasing any personal information.

You may close your GuildQuality Homeowner, Crewmember, or Guildmember account by contacting GuildQuality at support@guildquality.com.

Further, you may request that your personal information be removed from all GuildQuality systems. This request must be made in writing to the address provided below or by emailing at support@guildquality.com. You understand that if you request removal of your personal information you will no longer have access to any existing GuildQuality account and will not be able to use any GuildQuality Services. Note that we may not accommodate your request if we believe the change would violate any law or legal requirement, and that GuildQuality will require you to verify your identity prior to releasing and/or removing any personal information. GuildQuality reserves the right to retain certain account information for its recordkeeping or compliance purposes, and to retain anonymized information, including the text provided in any review or feedback survey, indefinitely.

If you are a consumer that does business with a Guildmember that utilizes GuildQuality Services, that Guildmember may have uploaded your personal information to our systems and you may have provided solicited or unsolicited feedback, ratings, and survey responses via our Services. You can request that a Guildmember provide you with access to the personal information stored in GuildQuality systems on its behalf, provide you with a list of all third party services to which it transferred your personal information collected via GuildQuality Services, that it make changes to that personal information, or that the personal information be deleted from GuildQuality or other third party systems; GuildQuality cannot honor such requests.

Note that using the system delete function to remove any data, or to remove any personal data associated with your account, only restricts viewing that data from any system interface and prevents utilizing that data for any system function. It does not permanently delete the data from GuildQuality systems, nor does it remove the data from any third party systems to which it may have been transferred. To have any personal data deleted from third party systems, you must directly contact the companies controlling those systems. To have any personal data permanently deleted from GuildQuality systems, you must make an official request in writing to the address provided below or by emailing support@guildquality.com, that includes the specific information that you would like permanently deleted from GuildQuality systems. Note that GuildQuality will require you to verify your identity prior to executing any request to permanently delete data.

California residents may request and obtain from us a list of what personal information (if any) we disclosed to third parties for direct marketing purposes in the preceding calendar year and the names and addresses of those third parties. You may make one request each year by contacting us as set forth below.

Dispute Resolution

If you have any questions or concerns, please contact GuildQuality by e-mail at support@guildquality.com. We will do our best to address your concerns. If you feel that your complaint has been addressed incompletely, we invite you to let us know for further investigation. If we are unable to reach a resolution to the dispute, you and GuildQuality will settle the dispute exclusively as set forth in the Terms of Service.

A Note About Children
